1. Who we are

withSolène is an AI companion application operated by:

2. Eligibility

You must be at least 13 years old to use withSolène. If you are between 13 and 17, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By subscribing, you confirm that you are authorised to use the payment method you provide.

withSolène is not intended for children under 13.

3. Acceptance

By downloading or using withSolène, you agree to these Terms. If you do not agree, do not use the app.

4. Account

You are responsible for maintaining the security of your account. Do not share your login credentials. Notify us immediately if you suspect unauthorised access at hello@withsolene.com.

5. Subscriptions and billing

Important: Your subscription renews automatically each month. You will be charged the applicable subscription fee on your renewal date unless you cancel before then. Cancel through the App Store (iOS Settings → your name → Subscriptions), Google Play (Play app → profile → Payments & subscriptions → Subscriptions), or at withsolene.com/account if you subscribed on the web.
  • Access to withSolène requires an active monthly subscription.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • You retain full access until the end of the current billing period after cancellation.
  • We do not charge cancellation fees.
  • Refunds are handled in accordance with our Refund Policy.

6. Right of withdrawal (EU and EEA users)

If you are located in the European Union or European Economic Area, you have a statutory right to withdraw from this contract within 14 days of purchase without giving any reason.

However, by completing your subscription, you explicitly request that withSolène begins providing the service immediately. You acknowledge that, by requesting immediate commencement of the service, you waive your right of withdrawal in accordance with Article 16(m) of the EU Consumer Rights Directive and §356(5) of the German Civil Code (BGB).

This waiver is confirmed by the checkbox you complete at the time of subscription.

If you did not receive immediate access to the service, your right of withdrawal is not affected by this clause. Please contact hello@withsolene.com.

7. Artificial intelligence disclosure (EU AI Act Article 50)

withSolène is powered by artificial intelligence. In accordance with Article 50 of the EU Artificial Intelligence Act (Regulation EU 2024/1689), which applies from 2 August 2026, we make the following disclosures:

  • You are interacting with an AI system, not a human being. withSolène displays a permanent AI indicator within the app interface at all times during use.
  • The AI models powering withSolène are provided by third-party providers including Anthropic, OpenAI, and/or xAI. These providers are subject to their own regulatory obligations as general-purpose AI (GPAI) model providers.
  • withSolène is classified as a limited-risk AI system under the EU AI Act. It does not perform biometric identification, credit scoring, employment screening, or other activities that would classify it as high-risk under Annex III of the Act.
  • withSolène does not use emotion recognition systems based on biometric data.
  • withSolène does not employ subliminal manipulation techniques, exploit user vulnerabilities, use guilt-based retention tactics, or apply social scoring — all of which are prohibited under Article 5 of the EU AI Act (in force since 2 February 2025).
  • AI-generated content produced by withSolène may carry machine-readable metadata identifying it as AI-generated, in accordance with Article 50(2) of the EU AI Act.

8. Acceptable use

You agree not to:

  • Use withSolène for any unlawful purpose.
  • Attempt to reverse-engineer, scrape, or otherwise extract data from the service.
  • Impersonate any person or entity.
  • Use the service to harass, abuse, or harm others.
  • Attempt to circumvent content moderation or safety systems.
  • Use the service to generate, distribute, or promote illegal content.

9. AI-generated content — limitations

withSolène's responses are generated by artificial intelligence and may be inaccurate, incomplete, or inappropriate in some cases. They do not constitute professional advice of any kind — including medical, legal, financial, or psychological advice.

Do not rely on withSolène's responses in situations where professional advice is essential. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services in your country.

10. Intellectual property

The withSolène app and all its content are owned by us or our licensors. You retain ownership of the content you create within the app.

11. Termination

We may suspend or terminate your account if you violate these Terms.

For minor violations, we will where reasonably practicable provide notice and an opportunity to remedy the issue before termination. For serious violations — including illegal activity, abuse of other users, or circumvention of safety systems — we may terminate immediately without prior notice.

You may delete your account at any time from within the app (the app menu (···) → Delete my account). Deletion is processed within 30 days.

12. Disclaimer and liability

withSolène is provided "as is" without warranty of any kind. To the fullest extent permitted by applicable law, we disclaim all warranties.

Our total liability to you for any claim arising out of or relating to these Terms or your use of withSolène is limited to the amount you paid us in the preceding 12 months.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by applicable law, including obligations arising under the EU Product Liability Directive (Directive 85/374/EEC as revised by Directive 2024/2853/EU).

13. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be resolved exclusively in the competent courts of Karlsruhe, Germany.

Notwithstanding the above, nothing in these Terms limits any consumer rights you may have under the mandatory laws of your country of residence.

We are not obliged to participate in alternative dispute resolution proceedings but are willing to do so in individual cases. Contact us at hello@withsolene.com to discuss.

14. Changes to these Terms

We may update these Terms from time to time. We will notify you of significant changes via the app or by email at least 14 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
